NPP Reps to Appeal Medical Marijuana Regulations

SAN JUAN – New Progressive Party (NPP) Reps. María Milagros Charbonier and Carlos ‘Johnny’ Méndez said Thursday they would appeal the decision of San Juan Court Judge Ángel Pagán Ocasio, who dismissed their claim, which challenged the regulations of the Health Department regarding the use of medical marijuana in Puerto Rico.

“We respect the honorable court’s decision, but differ with it. We believe this is a constitutional matter…, that is why we are announcing we will go to the Puerto Rico Court of Appeals for that forum to address our claim, which is fair and based on law,” Charbonier said in a statement issued Thursday.

“The usurpation of legislative powers is clear and palpable,” the legislators stated. “We cannot allow that our legislative powers be removed while a regulation that endangers people’s health is enacted,” sated Méndez, who serves as deputy spokesman for the NPP’s House delegation.
